PD: Landlord Boards up Apartment, Denying Access to Mom, Kids

Middletown Police arrested homeowners Marilyn and Brian Phillips after officers and a health department sanitarian insisted they allow the family to re-enter their residence.

The following police reports are obtained directly from the Middletown Police public information officer and inclusion on this list reflect charges filed, not convictions.

On Sept. 12 at 2:53 p.m., police were called to an apartment on Spring Street by a woman who said her landlords, Brian J. Phillips, 69, and Marilyn A. Phillips, 65, both of Ridge Road, had shut off her water and electricity at 5 p.m., according to the report, in the locked basement. 

A health department inspector told police she was putting the mother and her children in a hotel room for the weekend and was charging the landlords for it.

On Sept. 16 at 8:30 p.m. Phillips came to police headquarters saying he boarded up with apartment with plywood, according to the report. Although officers told him he could not do so even though the woman didn't have a lease and he'd have to evict her, he told detectives to arrest him. 

Police again told Phillips at 9:40 p.m. that he had to remove the wood and allow the victim to get her children's clothes, which he refused.
